§ 2. Definitions
- Package, camp - a LASTOUT trip combining at least two types of travel services (e.g. accommodation and surf coaching), described on the Website or in an offer.
- Traveller - any person who seeks to conclude a contract or is entitled to travel on the basis of a contract.
- Lead Booker - an adult who makes a booking for themselves or for other Travellers.
- Contract - the package travel contract.
- Durable medium - a medium that makes it possible to store information and reproduce it unchanged, e.g. an e-mail or a PDF.
- Act - the ustawa z dnia 24 listopada 2017 r. o imprezach turystycznych i powiązanych usługach turystycznych (Polish Package Travel Act of 24 November 2017).
- Unavoidable and extraordinary circumstances - a situation beyond our control the consequences of which could not have been avoided even if all reasonable measures had been taken (art. 4 point 15 of the Act), e.g. a natural disaster or a serious security risk at the destination.
§ 3. Conclusion of the contract
- You make a booking in our Booking system, by e-mail, by telephone or in person. A booking may be made by an adult with full legal capacity.
- Before you conclude the contract, we provide you with:
- the standard information form (Annex 1 to the Act) - Information form;
- the information required by art. 40(1) of the Act: the itinerary, place, dates, number of nights, accommodation, meals, services, minimum number of participants, price including additional charges, method of payment, documents and visas, information on the possibility of withdrawal and on insurance;
- these Conditions and the general terms and conditions of insurance.
- The contract is concluded when we confirm the booking on a durable medium (by e-mail) and you pay the deposit on time. Merely submitting the form in the Booking system is an expression of interest in taking part, not the conclusion of a contract.
- At the time the contract is concluded, or without undue delay afterwards, we provide you on a durable medium with a confirmation of the contract setting out the full content of the agreement (art. 42 of the Act) and with written confirmation that we hold financial security and pay contributions to the Turystyczny Fundusz Gwarancyjny, stating how to claim payment from them.
- The contract consists of: the booking confirmation, the description of the chosen camp (itinerary and services), these Conditions, the standard information form and the insurance terms.
- The Lead Booker is responsible for paying the price for everyone in the booking and passes on to them the information and documents received from us.
- We try to meet special requests (e.g. a room next to friends, a diet). We are bound only by those we confirm on a durable medium.
§ 4. Price and payments
- We quote prices in euro (EUR) per person. They include VAT at the applicable rate and the contributions to the Turystyczny Fundusz Gwarancyjny (Tourist Guarantee Fund).
- The deposit is 30% of the price and is payable within 3 days of the booking confirmation. Without the deposit the booking lapses and the contract is not concluded.
- You pay the balance of the price no later than 21 days before the start of the camp. If you book later than 21 days before the start, you pay the full price within 3 days of the booking confirmation.
- We accept payment by bank transfer to the account stated in the booking confirmation. The date of payment is the date the funds are credited to our account. In the transfer reference, state the Traveller's first name and surname and the name and dates of the camp.
- If you do not pay the balance on time, we will ask you to pay, setting an additional deadline of at least 3 days. If that deadline passes without payment, we may terminate the contract and deduct the termination fee under § 9.
- Once the contract has been concluded, we do not increase the price.
- Room supplements (e.g. a double room) and additional services (e.g. an insurance extension) are stated before the contract is concluded. You do not bear any charges we did not inform you of before the contract was concluded (art. 40(5) of the Act).
§ 5. What the price includes
- The scope of services of each camp (nights, meals, number of training sessions, video analyses, equipment, local transfers) is set out in its description on the Website and in the booking confirmation.
- Unless the description states otherwise, the price does not include: flights and travel to the place where the camp starts, meals other than those listed in the description, personal expenses, local and visa charges indicated in the description (e.g. the Mentawai Surf Tax), hire of boards other than softboards, or additional activities.
- You arrange your flights yourself. We are happy to help you choose a connection, but we are not a party to the contract of carriage. A delayed or cancelled flight does not release you from paying for the camp, unless it results from circumstances for which we are responsible.
- Check-in at the accommodation usually starts at 14:00-16:00 and check-out is usually at 10:00-12:00 local time. We give the exact times before departure.
- Photos on the Website and on social media are for illustration only.
§ 6. Insurance
- We insure every Traveller for the duration of the camp against medical expenses (KL) and personal accident (NNW), extended to cover amateur surfing. The insurer is Compensa Towarzystwo Ubezpieczeń S.A. Vienna Insurance Group.
- We provide the general terms and conditions of insurance (OWU) before the contract is concluded.
- People with chronic illnesses can buy an extension of cover in the Booking system.
- We recommend additional cancellation insurance.
- You report claims directly to the insurer in accordance with the OWU. We help with contacting the insurer.
§ 7. Insolvency protection
- The Organiser holds insurance guarantee no. COR729819 issued by Compensa TU S.A. Vienna Insurance Group, valid from 1 January 2026 to 31 December 2026, for the amount of 192 006 zł (equivalent to 45 000 EUR). The beneficiary of the guarantee is the Marszałek Województwa Wielkopolskiego.
- The Organiser pays contributions to the Turystyczny Fundusz Gwarancyjny (Tourist Guarantee Fund) administered by the Ubezpieczeniowy Fundusz Gwarancyjny (Insurance Guarantee Fund, UFG).
- The guarantee and the Fund ensure a refund of payments for a camp that does not take place because of the Organiser's insolvency, a refund of the part of the payments relating to the part of the camp not delivered, and, if the camp is already under way, coverage of the costs of continuing it or of repatriation.
- In the event of the Organiser's insolvency, contact the Marszałek Województwa Wielkopolskiego (Urząd Marszałkowski Województwa Wielkopolskiego w Poznaniu (Marshal's Office of the Wielkopolska Region in Poznań), al. Niepodległości 34, 61-714 Poznań) or the guarantor: Compensa TU S.A. Vienna Insurance Group. Copy of the certificate: Certificate.
§ 8. Changes to the contract before departure
- Before departure we may unilaterally change the contract only in the cases set out in art. 45 and 46 of the Act. We may make insignificant changes (e.g. the meeting time, swapping a spot for a nearby one) by informing you on a durable medium.
- If we have to significantly alter the main characteristics of the camp (e.g. the dates, place, standard of accommodation) or cannot fulfil confirmed special requirements, we will notify you without undue delay on a durable medium. We may also offer a substitute camp.
- Within a reasonable period set by us you may:
- accept the change, or
- withdraw from the contract without paying a fee and with a full refund of your payments, or
- withdraw from the contract and accept the substitute camp.
- If you do not reply within that period, we treat this as your withdrawal from the contract with a full refund of your payments and without a fee.
- Where the change or the substitute camp results in lower quality or lower cost, you are entitled to a price reduction. We make refunds within 14 days of termination of the contract.
§ 9. Withdrawal from the contract by the Traveller
- You may withdraw from the contract at any time before the start of the camp. A statement sent by e-mail or by letter is enough. What counts is the day on which we receive it.
- If you withdraw, you pay a termination fee. Its amount depends on how many days before the start of the camp we receive your statement:
| When you withdraw | Fee (percentage of the camp price) |
|---|---|
| from conclusion of the contract to the 31st day before the start | 29% |
| from the 30th to the 25th day before the start | 30% |
| from the 24th to the 20th day before the start | 50% |
| from the 19th to the 15th day before the start | 75% |
| from the 14th to the 2nd day before the start | 90% |
| 1 day before the start and on the day of the start | 100% |
- The fees reflect the expected costs we will not recover (bookings of accommodation, coaches, transport, equipment), less expected cost savings and income from reselling the place. At your request we will justify the amount of the fee. If we resell the vacated place, we will reduce the fee by the income obtained, but not below the costs actually incurred.
- We deduct the fee from your payments. We refund any surplus within 14 days.
- If you do not turn up for the camp on the start date or do not have the documents required for entry, we treat this as withdrawal on the day of the start.
- You may withdraw from the contract without paying any fee if unavoidable and extraordinary circumstances occur at the destination or in its immediate vicinity that significantly affect the delivery of the camp or the carriage of passengers to the destination. You will then receive a full refund of your payments (without compensation).
- For contracts concluded at a distance (internet, telephone, e-mail) there is no statutory 14-day right to withdraw without giving reasons (art. 38(1) point 12 of the ustawa o prawach konsumenta, the Polish Consumer Rights Act). If you concluded the contract off-premises (e.g. at a fair or an event), you may withdraw from it without cost within 14 days of its conclusion, unless the contract was concluded following oral negotiations on the basis of your prior order (art. 47(7) of the Act).
§ 10. Transfer of your place to another person
- You may transfer your place to a person who meets the conditions for taking part in the camp. You do not need our consent.
- Notify us on a durable medium (e.g. by e-mail) no later than 7 days before the start of the camp. Give the details of the new participant.
- If the change of participant involves additional costs (e.g. a name-change fee charged by a supplier), we will show them to you. The costs must be reasonable and may not exceed the actual costs. You and the new participant are jointly and severally liable for the unpaid part of the price and for those costs.
§ 11. Termination of the contract by the Organiser
- We may terminate the contract and refund all payments, without additional compensation, if:
- fewer people sign up for the camp than the minimum number of participants stated in the camp description and in the contract, and we notify you no later than 20 days before the start of a camp lasting more than 6 days, 7 days before the start of a camp lasting 2-6 days or 48 hours before the start of a camp lasting less than 2 days; or
- we are prevented from delivering the camp by unavoidable and extraordinary circumstances, and we notify you without undue delay before the start of the camp.
- We make refunds within 14 days of termination of the contract.
§ 12. Delivery of the camp and our liability
- We are responsible for the performance of all services included in the contract, including those provided by our partners (accommodation providers, local coaches, local transport providers).
- We adapt the training plan every day to the forecast (swell, wind, tides) and to safety. A change in the order of sessions, of the spot or of the times within the programme is not a lack of conformity with the contract, provided we maintain the scope of services.
- If you notice that something is not being performed in accordance with the contract, inform us without undue delay, where possible while the camp is still under way (the team representative on site or the contact details in § 1 section 3). We will remedy the lack of conformity, unless that is impossible or would entail disproportionate costs.
- If we do not remedy the lack of conformity within a reasonable period set by you, you may do so yourself and request reimbursement of the necessary expenses.
- If we cannot provide a significant proportion of the camp, we will offer suitable alternative arrangements at no extra cost. Where the lack of conformity substantially affects the camp and we do not remedy it within a reasonable period, you may terminate the contract without paying a fee.
- You are entitled to a price reduction for any period during which there was a lack of conformity, unless it was caused solely by you. You are also entitled to compensation for damage or for non-material harm (zadośćuczynienie), unless we prove that the lack of conformity is attributable to you, to a third party unconnected with the provision of the services (and could not have been foreseen or avoided), or that it was due to unavoidable and extraordinary circumstances.
- We limit compensation to three times the total price of the camp. The limitation does not apply to personal injury or to damage caused intentionally or through negligence.
- Where, because of unavoidable and extraordinary circumstances, the return cannot be ensured as provided for in the contract, we bear the cost of necessary accommodation for up to 3 nights. The limit does not apply to persons with reduced mobility and their companions, pregnant women, unaccompanied minors and persons in need of specific medical assistance, if we were notified of their situation at least 48 hours before the start of the camp.
- If you find yourself in difficulty, we will give you assistance without undue delay: we will provide information on health services, local authorities and consular assistance, and help you to communicate and to find alternative arrangements. We may charge a fee for this assistance only if the difficulty was caused solely by your intentional fault or gross negligence, and only up to the actual costs.
- We are liable for our booking errors, unless the error is attributable to you or to unavoidable and extraordinary circumstances.
- Claims for a price reduction, compensation for damage or compensation for non-material harm become time-barred after 3 years.
§ 13. Your obligations and safety
- Surfing is a physically demanding sport and carries a risk of injury. Taking part requires basic swimming ability and generally good health.
- Before departure, inform us of any health contraindications, injuries, pregnancy or other circumstances relevant to safety. This will help us choose suitable activities. This information is voluntary and we process it with your consent.
- In the water and during training sessions, follow the coaches' safety instructions. A coach may exclude from a session a person whose condition (e.g. after drinking alcohol) or behaviour endangers themselves or others.
- Make sure you have valid travel documents: a passport valid for at least 6 months from the date of entry for trips outside the European Union, an identity card or passport within the EU, visas and entry fees (e.g. Visa on Arrival in Indonesia). You can check current requirements at gov.pl/web/dyplomacja. Lack of documents does not release you from paying for the camp.
- You are liable for damage you cause through your own fault, including damage to equipment entrusted to you beyond normal wear and tear.
- Pets cannot be brought.
§ 14. Children and young people
- Minors may take part in a camp only under the care of a parent or legal guardian who also takes part in the trip, unless we agree otherwise on a durable medium.
- At Family Camps, at set times, we provide activities for children supervised by a qualified carer. Outside those times, parents are responsible for supervision.
§ 15. Special needs
- The camps involve physical activity in the water and on land. The accessibility of accommodation for persons with reduced mobility varies. Write to us before booking and we will tell you whether a given camp is suitable for you.
- Report any needs relating to local transport or accommodation no later than 7 days before the start of the camp.
§ 16. Complaints
- You may submit a complaint in any form: on site to a team representative, by e-mail or by post to the address in § 1. Describe what did not conform to the contract and what you expect.
- Report a lack of conformity as soon as possible, ideally while the camp is still under way - then we can put it right. A later report does not deprive you of your rights, but it may affect the amount of the price reduction or compensation if the delay made it harder to remedy the problem.
- We reply to a complaint within 14 days of receiving it, on paper or another durable medium (e.g. by e-mail). If we do not reply within that period, the complaint is deemed accepted (art. 7a of the ustawa o prawach konsumenta, the Polish Consumer Rights Act).
§ 17. Out-of-court dispute resolution
- If we cannot reach agreement, you may use out-of-court dispute resolution, including:
- mediation or the permanent consumer arbitration court at the Wojewódzki Inspektorat Inspekcji Handlowej w Poznaniu (Regional Trade Inspection in Poznań);
- the free assistance of a municipal or district consumer ombudsman (rzecznik konsumentów) or a consumer organisation.
- The list of entities authorised to resolve consumer disputes is kept by the President of UOKiK (Urząd Ochrony Konkurencji i Konsumentów, the Polish Office of Competition and Consumer Protection) (uokik.gov.pl).
- The EU ODR platform referred to in art. 42(4) point 5 of the Act ceased to operate on 20 July 2025.
§ 18. Personal data, photos and recordings
- The controller of Travellers' data is the Organiser. Details: Privacy Policy.
- Recordings of training sessions (from the shore, from the water, from a drone) are part of the video analysis. We make them and share them with you under the contract.
- We publish your image (e.g. on Instagram or on the website) only with your separate, voluntary consent. Not giving consent does not affect your participation in the camp. You can withdraw your consent at any time.
§ 19. Final provisions
- You may not waive the rights conferred on you by the Act. Provisions less favourable than the Act are invalid, and the Act applies in their place.
- In matters not regulated here, we apply the Act, the ustawa o prawach konsumenta (Polish Consumer Rights Act) and the Kodeks cywilny (Polish Civil Code). Text of the Act: isap.sejm.gov.pl.
- These Conditions are governed by Polish law, without prejudice to the protection afforded to a consumer by the mandatory provisions of the law of the country of their habitual residence.
- You may make statements relating to the contract by e-mail. Let us know if your e-mail address changes - until then we send messages to the address given when booking.
